We may also collect photos of completed projects and reviews or testimonials, but we will use them to identify you or your property only with your consent. We may collect information needed to obtain municipal building or pool-enclosure permits and utility locates.
Business Relationship Records – For contractors, business partners, and franchise operators and their personnel, we may collect information about training and support, territory and sites, business operations, performance and sales, royalty and fee reporting and payments, marketing-fund administration, business systems used, audits, brand-standards compliance, renewals, transfers, and other communications and records relating to our agreements with them.
(b) Information Received from You as Part of Your Communications
When you contact us or we communicate with you by phone, email, text, social media, online forms, or in person, we may keep records of the communication. These records may include your name and contact details, the information you provide, the nature and purpose of the interaction, scheduling or site-access details, and how we responded. We may record service-related notes needed to provide safe and effective work.
(c) Information Collected Automatically
When you access or use the Website, we may automatically collect limited information about your device and your activity. This information may include:
Technical Information – We may collect your Internet Protocol (IP) address, device type, browser type, operating system, approximate location, unique device or online identifiers, and related technical information. We use this information for security, troubleshooting, service administration, and statistical purposes.
Site Usage Information – We may collect the page you visited before coming to the Website, the pages and features you view, the links you click, the time you spend on the Website, and other usage information. We use it to understand Website traffic and improve the Website and Services.
Cookies and Similar Technologies – We may collect information through cookies and similar technologies to remember preferences, support Website functions, and understand Website use. See Section 3 for more information.
(d) General Location Information
We may collect general location information, such as an approximate location inferred from your IP address or the service address you provide. We use it to determine service areas, plan site visits, provide recommendations, improve the Website and Services, and support safety and scheduling.
(e) Personal Information from Publicly Available Sources and Third Parties
We may receive Personal Information from people who refer you to us, builders, landscapers, general contractors, trade partners, business partners, public sources, social media platforms, franchise operators, and other third parties, including, for franchise applicants, references and credit or background-check providers. We may use this information to respond to a request, coordinate a project, administer our business relationships, or provide the Services. Where appropriate, we expect the source to have authority to share the information with us.
(f) Additional Information from Franchise Applicants
If you apply for a Betz Pools franchise, we may collect the following information in addition to the information described above.
Franchise Application and Due-Diligence Information – If you, or an organization you own or represent, apply for a Betz Pools franchise, including as an owner, principal, guarantor, or key person, we may collect information in an inquiry or application, business experience and qualifications, references, ownership and organizational structure, government identification, financial information such as net worth and liquidity, and information from credit or background checks where permitted by law. We may also collect related communications, site and territory information, and information needed to evaluate candidacy, conduct due diligence, and meet franchise disclosure obligations.
3. Use of Cookies and Other Tracking Technologies
We may use cookies, web beacons, pixels, embedded content, and similar technologies on the Website to support Website functions, understand how visitors use the Website, remember preferences, and measure communications or advertising.
(a) Cookies
Cookies are small text files that a website or its provider places on your device through your browser. They allow the Website to recognize your browser, remember information, and support certain functions.
How We Use Cookies – We may use first-party and third-party cookies to make the Website work, remember preferences, understand Website traffic, improve the Website and Services, help protect the Website, and, where applicable, measure or personalize advertising.
How to Manage Cookies – You can manage or disable cookies through your browser settings. If you disable cookies, some Website features may not work as intended.
(b) Web Beacons, Pixels, and Embedded Content
Web beacons, pixels, and similar technologies may be included in webpages, emails, or social media content. They can help us count visitors, understand whether an email was opened, measure a campaign, and evaluate Website or advertising performance. Unlike cookies, which are stored on the user’s hard drive, web beacons are typically embedded invisibly on webpages (or in an email).
(c) Online Analytics and Advertising Technologies
We may use third-party analytics tools to understand how visitors interact with the Website and improve our Services. You may be able to limit or opt out of certain analytics through your browser settings or opt-out tools made available by the relevant analytics provider.
4. Use of Your Personal Information
We use Personal Information for the purposes described below, as reasonably needed to provide the Services, operate our business and administer our business relationships, and comply with law:

(b) To Evaluate and Administer Business Relationships
We use Personal Information to evaluate, establish, and administer our relationships with contractors, suppliers, business partners, and franchise operators. For individuals who apply for a Betz Pools franchise, this includes responding to inquiries, assessing qualifications and financial capacity, conducting due diligence, obtaining and reviewing references, conducting credit and background checks where permitted, preparing franchise disclosure materials, and deciding whether to approve a franchise relationship. For franchise operators and their personnel, this includes administering franchise agreements, providing training and support, maintaining brand standards, conducting audits, collecting royalties and other fees, administering marketing funds, managing renewals, transfers, and terminations, and managing related communications and records.
(c) To Maintain, Support, Improve, and Personalize the Services

Your Personal Information may also be used to improve the content and/or functionality of the Services. For example, it may be used to help us improve our offerings. We may use Personal Information, such as your service history, pool chemistry, equipment information, and other pool-related needs, to better understand your needs and personalize communications, recommendations, and service offerings based on your relationship and history with Betz Pools. We do not engage in interest-based or behavioural advertising.
(d) To Communicate with You
We use Personal Information to answer questions, provide estimates, confirm appointments, coordinate site access, send invoices and service updates, provide seasonal opening and closing reminders, administer warranties, and send marketing communications where permitted and with the consent required by law. Commercial electronic messages are addressed in Section 12.
(e) For Safety and Security Purposes
We use Personal Information to protect customers, visitors, staff, technicians, and our business; manage safe access to properties; identify and address suspicious activity; protect the Website and our systems; and investigate or prevent incidents, fraud, misuse, or security risks.

When you access or use our Website or Services or otherwise deal with us, you may be bound by applicable terms, purchase or service agreements, franchise agreements, and our policies, including this Policy. To administer and enforce those arrangements, we process Personal Information to monitor, investigate, prevent, and mitigate alleged or actual prohibited, illicit, or illegal activities; investigate, prevent, or mitigate violations of our agreements or policies; enforce agreements with third parties and business partners; and assess and address compliance with our standards, including brand standards.
(h) To Protect Our Customers, Staff, and Business
We may use Personal Information to protect our legal rights, enforce contracts, collect amounts owing, resolve disputes, investigate damage or incidents, support insurance matters, and protect the safety and property of our customers, staff, and trade partners.
(i) To Administer Our Business
We may use Personal Information for accounting, billing, purchasing, inventory and order management, project management, quality assurance, training, insurance, business planning, audits, royalty and fee collection, marketing-fund administration, performance reporting, and other ordinary business activities consistent with this Policy.
(j) With Your Consent or for Other Disclosed Purposes
We may use Personal Information for another purpose disclosed when we collect it or for which you provide consent. We will not use Personal Information for materially different purposes without the consent or legal authority required by applicable law.
5. Sharing of Personal Information with Third Parties
We do not sell your Personal Information. We share it only as reasonably needed for the purposes described in this Policy, to provide the Services, to administer our business relationships, to comply with law, or with your consent or direction. Personal Information, including customer information, may also be shared with or received from independently owned franchise locations to provide services, support operations, or administer our franchise system.
(a) Service Providers, Contractors, and Project Partners
We may share Personal Information with service providers such as payment processors, technology, software, and cloud-service providers (including providers of eCommerce, scheduling, customer-management, hosting, communications, marketing, and analytics services), shipping and delivery providers, customer-support providers, credit and background-check vendors, and other vendors supporting our business and services. We may also share information with subcontractors and trade partners, including electricians, excavation contractors, landscapers, gas fitters, and fencing contractors, when needed for your project; equipment manufacturers and suppliers for warranty or support; municipalities and utilities for permits and locates; financing providers at your request; and insurers, lawyers, accountants, and other professional advisers. These recipients may use the information only for the services or purposes for which it was provided, subject to their legal obligations and contractual protections where appropriate.
(b) Independently Owned Franchise Locations
Franchise operators are independent businesses and are responsible for complying with privacy laws and giving appropriate notice and obtaining any required consent when they collect, use, or disclose Personal Information, including information about their personnel that they provide to Betz Pools. Data sharing between Betz Pools and franchise operators is also governed by the applicable franchise agreements. We may include franchise operator contact information in a franchise disclosure document or other disclosure where required by applicable franchise disclosure law. We may disclose relevant Personal Information to a prospective purchaser or transferee in connection with a franchise transfer, subject to applicable law and appropriate confidentiality protections.
(c) When Required or Permitted by Law
We may disclose Personal Information to courts, regulators, law-enforcement agencies, municipalities, utilities, or other parties where required or permitted by law, including to respond to legal process, protect rights and safety, investigate fraud or incidents, or comply with a lawful request.
(d) Corporate Transactions
If Betz Pools is involved in a sale, transfer, financing, amalgamation, merger, reorganization, dissolution, or similar transaction, or if a franchise is being renewed, transferred, or sold, Personal Information may be transferred to the parties involved, including a prospective purchaser, lender, transferee, or adviser, as part of that transaction. We will handle the information consistently with this Policy or provide any notice required by law.
(e) With Your Consent or at Your Direction
We may share or disclose Personal Information with your consent or at your direction, including when you ask us to coordinate with a builder, landscaper, contractor, lender, family member, or authorized representative.
6. Consent
Betz Pools generally seeks consent to collect, use, and disclose Personal Information, as required by applicable law. Consent may be express, such as when you sign a form, check a box, or clearly agree to a specific use, or implied where the purpose is obvious and you voluntarily provide the information for that purpose. Where permitted by law, we may collect, use, or disclose Personal Information without consent where reasonably necessary for a legal, contractual, security, or business purpose. If you operate a Betz Pools franchise, you are responsible for giving notice to and obtaining any consent required from your personnel and other individuals whose Personal Information you provide to Betz Pools. We will not make consent a condition of service unless the information is reasonably necessary for the Services or the law permits us to do so.
You may withdraw consent at any time by contacting us, subject to legal or contractual restrictions and reasonable notice. For individuals who apply for or operate a Betz Pools franchise, withdrawal may not be available where processing is reasonably necessary to evaluate or administer a franchise relationship, perform a franchise agreement, conduct required due diligence, maintain required records, collect amounts owing, protect our franchise system, or comply with law. Withdrawal may also mean that we cannot provide a service, complete a project, process a payment, maintain a warranty, communicate about an appointment, or continue another activity that depends on the information. Withdrawal does not affect processing already carried out with consent or processing permitted or required by law.
Consent for commercial electronic messages is addressed in Section 12 and is subject to Canada’s Anti-Spam Legislation (CASL).
7. Security of Personal Information
We use reasonable physical, organizational, and technological safeguards appropriate to the sensitivity of the Personal Information. These safeguards may include access controls, secure storage and transmission practices, staff training, confidentiality obligations, backup and incident-response procedures, and secure disposal. Access is limited to staff, franchise operators, service providers, and other parties who need the information for their work and are authorized to receive it. Technicians and franchise operators may receive access to site information, gate codes, pet notes, customer information, and other details needed to provide services safely. No method of storage or transmission is completely secure, and we cannot guarantee absolute security.
You also play a role in protecting your Personal Information. Please use care when sending information by email, text, social media, or other online channels, protect any access credentials or gate codes, and tell us promptly if you believe information has been misused or disclosed improperly.
8. Retention and Destruction
We retain Personal Information only for as long as reasonably necessary to fulfil the purposes for which it was collected, including to provide the Services, maintain customer, service, warranty, employment, and business relationships, administer franchise agreements, maintain records of transactions, comply with our legal obligations, resolve disputes, and enforce our legal agreements and policies. When Personal Information is no longer required, we will securely destroy or de-identify it in accordance with our internal retention and destruction practices, subject to applicable law.
If a franchise application is not approved, we may retain application, due-diligence, and related records for as long as reasonably necessary to document the evaluation, meet legal or franchise disclosure obligations, and resolve disputes. We will also retain Website usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen security or improve the functionality of our Services, or we are legally obligated to retain it for longer.
9. Your Rights
Subject to applicable law and reasonable exceptions, you may ask us to explain how we handle your Personal Information and to access, correct, withdraw consent to, or request deletion of it. These rights are not absolute and may be limited where we must retain information, protect another person’s privacy, preserve legal privilege, investigate an incident, administer or enforce our agreements, or comply with a legal or contractual obligation. The scope and availability of these rights may differ depending on your relationship with us, such as whether you are a customer, employee, business partner, franchise applicant, or franchise operator.
(a) Your Rights
The privacy-related rights described below apply subject to applicable law. Individuals who apply for or operate a Betz Pools franchise, and their personnel, may have additional contractual or statutory obligations and limitations relating to information used for due diligence, franchise administration, compliance, and records management.
Access – You may ask what Personal Information we hold about you, how we use it, and to whom we have disclosed it, subject to applicable exceptions.
Correction – You may ask us to correct an error or omission in your Personal Information. Where appropriate, you may also request a copy of your Personal Information in a commonly used electronic format. Contact details for these requests are provided in Section 16.
(b) Making a Privacy Request
To make an access, correction, consent-withdrawal, or deletion request, contact our Privacy Officer using the details in Section 16. We may ask you to verify your identity before responding. You may use an authorized representative, but we may require written authorization or a power of attorney and may verify the representative’s identity and authority. For franchise applicants, franchise operators, and their personnel, we may also coordinate a request with the applicable franchise operator or Betz Pools personnel responsible for the relevant records, subject to confidentiality, legal, and contractual restrictions.
We will respond to a written access request within thirty (30) days, or alternatively, the timeframe prescribed by the relevant legislation, subject to permitted extensions and exceptions.
10. Transfer of Personal Information
Betz Pools is based in Ontario, Canada. Personal Information may be stored or processed in Canada and may also be accessed, stored, or processed outside Canada by our service providers, including in the United States or other jurisdictions.
When Personal Information is handled outside Canada, it may be subject to the laws of that jurisdiction, which may permit access by courts, law-enforcement agencies, or regulators. We select service providers and use contractual, organizational, and technological safeguards intended to protect Personal Information during these transfers.
Our service providers may use cloud-hosting, scheduling, payment, email, analytics, customer-support, or other systems located in Canada, the United States, or elsewhere.
By providing Personal Information or using the Website or Services, you acknowledge that transfers, storage, and processing may occur in Canada or elsewhere as described in this Policy. We will take reasonable steps to ensure that information is handled in a manner consistent with this Policy and applicable law.
11. Third-Party Sites
The Website or our communications may contain links to, or embedded content from, third-party websites and services, including social media, equipment manufacturers, suppliers, financing partners, mapping providers, and other contractors. Those third parties are not controlled by Betz Pools and may have their own privacy policies and practices. We are not responsible for their handling of Personal Information. Review their privacy policies before providing information to them.
12. Electronic Communications
If you provide the consent required by law, we may send commercial electronic messages by email or text about our Services, seasonal maintenance, promotions, franchise opportunities, or related information. We may also send service-related or franchise-administration messages without marketing content when reasonably needed to provide the Services or administer a franchise agreement, such as appointment confirmations, access instructions, invoices, safety notices, warranty information, opening or closing reminders, training notices, audit requests, and compliance communications.
Commercial electronic messages are subject to CASL and will include an unsubscribe mechanism where required. You may unsubscribe from marketing emails or texts at any time by using the instructions in the message or contacting us through Section 16. Unsubscribing from marketing will not stop service-related, transactional, safety, warranty, or legally required communications.
13. Children’s Privacy
The Website and Services are intended for adults and are not directed to children under 18. We do not knowingly collect Personal Information from children under 18. If you believe a child has provided Personal Information to us, contact the Privacy Officer so we can review and take appropriate steps.

We may update this Policy from time to time to reflect changes to our Services, technology, legal requirements, or privacy practices. We will post the updated Policy on the Website and revise the effective date above. Where required by law, we will provide additional notice or obtain consent before a material change takes effect.
